October 2023 Instagram Giveaway: Official Rules

Eligibility

Giveaway is eligible for US residents only and must be 18 years or older.  Giveaway is void where prohibited by law. 

Sponsorship

This giveaway is solely sponsored by Observer Tools and will be promoted through Instagram.  This giveaway hosted by Observer Tools is in no way sponsored, endorsed, administered by, or associated with Instagram. 

Agreement to Rules

By entering this giveaway, you are agreeing to the Observer Tools Instagram Giveaway Official Rules.  Observer Tools has the right to refuse, withdraw, or disqualify entries at our sole discretion. Participants agree to accept any decisions by Observer Tools, in relation to this giveaway, as final and binding.

Entry Period

This giveaway starts on October 1, 2023 and ends on October 31, 2023 at midnight (EST).

How to Enter

To enter, 1. follow the @observertools page on Instagram and 2. correctly answer the daily riddle before the end of that day.  Any fraudulent methods of entry or circumvention of the rules may result in the invalidation of a participant’s entries.

Prize

The winner of this giveaway will receive the product that is designated in the original riddle post for that day.  Retail value for these products ranges from $39.99-$124.99.  Shipping is included.  Acceptance of the prize grants Observer Tools the permission to use the winner’s entry, name, and likeness for advertising, promotion, and trade without further compensation or remuneration unless prohibited by law.

Odds

The odds of a participant winning is dependent upon their skill in correctly answering the daily riddle.

Selection and Notification of the Winner

The winner will be the first person with an eligible entry that correctly answers the riddle for that day.  The maximum times one person can win is two times.  The winner will be notified the same day via direct message on Instagram and announced on our Instagram page as a story highlight.  If the winner is found to be ineligible or doesn’t respond to our direct message, Observer Tools will select the next person to correctly answer the riddle for that day.  The prize will be shipped, free of charge, within 1 week of winning.

Observer Tools isn’t liable for the winner’s failure to receive notification of winning if he or she provided the wrong information to be able to receive the prize.

Receipt of the prize is upon the condition of compliance with federal, state, and local laws, etc.

Rights Granted by the Entrant

The participants grant Observer Tools the right to use the participant’s submission, voice, likeness, image, statements about the contest, etc., for publicity, news, advertising, promotional purposes, trade, and so forth, without any further notice, review, consent, compensation or remuneration.

Terms & Conditions

Observer Tools reserves the right to modify, suspend, cancel or terminate in the event that non-authorized human intervention, a bug or virus, fraud, or other causes beyond your control impact or corrupt the security, fairness, proper conduct, or administration of the giveaway.

Observer Tools has the right to disqualify anyone who violates the terms, as well as your rights to seek damages to the fullest extent permitted by law in cases where a participant has caused deliberate damage or undermined the legal operation of the promotion.

The Observer Tools' Warranty Policy does not apply to this Observer Tools giveaway or any other Observer Tools giveaway.

Limitation of Liability

A participant’s entry into this giveaway constitutes his or her agreement to release and hold harmless Observer Tools and its subsidiaries, affiliates, employees, etc., against all claims, liability, illness, injury, death, loss, etc., that occurs directly or indirectly from participation in the contest or use/misuse of the awarded prize.

Disputes

Participants agree, as a condition of participating in the promotion, that disputes not resolved between the participant and Observer Tools shall be individually resolved exclusively before a court located in Maryland, without resorting to any form of class action.  Entrants waive all rights to punitive, incidental, or consequential damages, and they waive all rights to have damages multiplied or increased.
